How a judicial auction works (in short)

Base price and appraisal. The auction base price starts from the appraised value set in the expert report. At the first sale it is usually close to market value; the real discounts come later.

Unsold auctions and price cuts. If no one bids, the judge sets a new attempt at a reduced price: up to −25% per round for real estate (art. 591 c.p.c.), −20% (one fifth) for movable goods, with a maximum of three sale attempts (artt. 538 e 532 c.p.c.).

Minimum offer. You can bid up to a quarter (−25%) below the base price (art. 571 c.p.c.): that’s why it pays to track lots that have already been marked down several times.

Deposit and costs. To take part you pay a deposit (usually ~10% of the offer), refunded if you don’t win; you should also factor in fees, sale costs and any VAT, plus transport and collection of the asset.

Frequently asked questions

What are judicial auctions?
They are sales of assets (real estate, machinery, vehicles, businesses) ordered by a court within enforcement proceedings or bankruptcy/insolvency procedures. By law, every sale notice is published on the Public Sales Portal (PVP) of the Italian Ministry of Justice.
How much do you save by buying at auction?
The award price is on average 25–35% below market value, and even more after auctions that go unsold. For residential property in cities the discount is usually smaller (20–30%); on villas and less sought-after areas it can exceed 40%. The real discount must always be checked on the individual lot.
What can you buy at judicial auctions?
Every category: residential, commercial and industrial property, land, vehicles, machinery and capital goods, furniture, warehouse stock, going concerns, IT equipment, boats, agricultural vehicles, art and jewellery.
What happens if an auction goes unsold? How much does the price drop?
When an auction goes unsold the judge sets a new attempt at a reduced price: for real estate the cut can reach a quarter (−25%) of the base price per round (art. 591 c.p.c.); for movable goods the cut is one fifth (−20%) and there are at most three sale attempts (artt. 538 e 532 c.p.c.).
What is the minimum offer to take part?
The offer cannot be more than a quarter (−25%) below the base price stated in the sale notice (art. 571 c.p.c.). It is therefore possible to win a lot by offering less than the base price.
Is a deposit required?
Yes: to take part you pay a deposit, usually around 10% of the offered price, which is returned to non-winning bidders. On top of that come fees and sale costs (plus VAT where applicable).
How do I receive only the lots that are right for me?
You set a profile — category of interest, area/province, price threshold — and you receive an alert when a matching lot appears, already with its opportunity score. So an agency sees only the property in its area, a reseller only the machinery in its category.
Where does the data come from?
From the official source — the Public Sales Portal (PVP) of the Italian Ministry of Justice, where every judicial sale must be published by law — enriched with the leading authorised portals for photos, appraisals and details. The asset data is public; we only handle information about the asset, never the personal data of the debtor.
